Acceptance

Momento is operated by M/S JYOTI TRADERS (HANUMAT KRIPA) (Jyoti Traders). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old (16 in the EEA/UK without parental consent where required) for general use. Guests joining an event with Find me enabled must be at least 18 — see Find me and people shown in photos below. We may update these terms; material changes will be posted on this page.

Roles and responsibility

  • Event hosts (and agencies or planners acting for a client) decide who is invited, what is collected, and whether optional features such as Find me are enabled. For guest photos and guest personal data in an event, the host is typically the data controller under privacy law. Momento provides the platform as a processor on the host's instructions.
  • Hosts, uploaders, and photographers — not Momento — are primarily responsible for providing attendee notice, obtaining permissions or consents, complying with venue or employer rules, and responding to people shown in photos who object or request removal.
  • By enabling Find me, importing photos, or allowing uploads, the host directs Momento to process event media as described in the Privacy Policy and authorises the subprocessors listed in our DPA.

Agency-billed events & host claim

  • Registered agencies may create and pay for events on behalf of a client. The agency accepts that it has the client's authorization to configure the event and share the client's email with Momento for handoff.
  • The invited client becomes the event host and data controller only after they sign in with the invited email and explicitly accept these Terms and the Privacy Policy on the claim screen.
  • Until claim is complete, the agency may see aggregate stats (guest and upload counts) but cannot access guest photos, the host dashboard, or host-only controls.
  • Optional features purchased by the agency — including Find me — are not activated for guest processing until the claiming host accepts any additional acknowledgements shown at claim.
  • Claim links sent by email may include a secure token. Clients should use the emailed link when possible. If a link expires, the agency can resend the invite from its dashboard.

Find me and people shown in photos

  • Find me is optional and only operates for an event when the host enables it. It may analyze faces in event photos and create event-scoped face descriptors to help a guest find their own photos.
  • Use Find me only to search for yourself. Do not submit another person's selfie or attempt to identify someone else without their permission.
  • Find me is a best-effort convenience feature, not identity verification or security screening. Results may vary.
  • Hosts and uploaders are solely responsible for compliance with privacy and biometric laws that apply to their event and jurisdiction, including notice, consent, and opt-out obligations for people who do not use Momento.
  • Guests joining a Find me event must confirm they are at least 18 years old. Hosts must not invite anyone under 18 to join or upload as a Momento user in those events.
  • Find me is not available for college events because attendees may include minors.
  • Before an uploader's first Find me event upload, Momento records a versioned declaration that the uploader has the right to upload the photos and has provided or obtained any notice, permission, or explicit facial-data consent required for people shown. Hosts and photographers make the same declaration for their own uploads and imports.
  • This declaration is evidence of the uploader's or host's commitment; it is not a substitute for consent where the law requires consent from a person shown, and it does not waive that person's legal rights.
  • Do not enable Find me, upload, or import photos containing someone if you do not have the authority required for the event and applicable law. You must promptly cooperate with any valid removal request.
  • Any person shown in an event photo, including a non-user, may request removal of the photo or event-specific face data at admin@momento.camera. See the Privacy Policy for the opt-out and verification process.

The Service

Momento is an event photo and video sharing platform. Hosts create events, share QR codes, and collect photos and 60-second video clips from guests. The platform generates AI recap videos from photos, awards, and sharing tools. The Service is provided "as is" without warranty of any kind.

Accounts

  • Hosts must create an account (email or Google sign-in) to manage events.
  • You are responsible for maintaining the security of your account credentials.
  • Guests do not need accounts. They access events via QR code or link.

Feedback

We welcome feedback, comments, and suggestions for improvements to the Service. By submitting feedback, you grant us the right to use it without restriction or compensation to you. All feedback becomes the sole and exclusive property of Momento.

Content and uploads

  • You retain ownership of photos you upload.
  • By uploading, you grant Momento a non-exclusive, worldwide license to store, display, and process your photos solely to provide the Service (gallery, recap, awards, stickers, watermarked downloads).
  • You represent that you have the right to upload the content, including photos of people who do not use Momento, and that it does not violate any law or third-party rights.
  • Hosts, planners, photographers, and guest uploaders are responsible for providing any required notice and obtaining any required permission or consent from people photographed at their events, including for optional Find me facial-data processing, and for complying with workplace, school, venue, and local biometric-privacy rules.
  • Commercial use restriction: Hosts are granted a limited license to view, share, and export photos uploaded by guests for personal, event, or internal purposes only. Any commercial use (e.g., advertising or marketing) of guest photos by a host requires explicit permission from the guest who uploaded them.
  • You must not upload illegal, harmful, harassing, defamatory, or infringing content.
  • Event hosts must moderate their events and respond to removal requests promptly.
  • We may remove content or suspend events that violate these terms. See our Copyright & Takedown policy.

Photo storage & deletion

  • Retention periods are targets, not guarantees. We aim to retain event photos, videos, and recaps for approximately 6 months (free plan) or 1 year (paid plans) after the event end date. Events created under an earlier paid window keep that original period. After media is removed, guestbook messages, award titles, and event stats may remain. These periods are operational best-effort estimates and do not constitute a contractual commitment to store photos for any fixed duration.
  • Photographer-imported photos (bulk import add-on) are subject to a shorter retention target of approximately 30 days after the event end date stated at purchase. This shorter period is disclosed at checkout and within the event dashboard. The add-on includes up to 1,000 host imports per event; removing photos from the gallery does not restore import slots.
  • "Unlimited" plans and add-ons are subject to fair use. The Unlimited guests plan and the Unlimited guest shots add-on are not literally infinite: each is capped at a high fair-use ceiling (100,000 total uploads per event; 1,200 photos per guest) intended to be far beyond any realistic single event, solely to prevent abuse and protect service stability for all users. Contact us if your event genuinely needs a higher ceiling.
  • Early deletion may occur at our discretion if required by operational constraints (e.g. storage costs), legal obligations, safety concerns, content policy violations, account termination, or inactivity. Where feasible, we will provide at least 7 days' advance notice via the host's registered email before initiating early deletion of an active event's photos.
  • Deletion is permanent in the Service. When you or a host deletes a photo or event, Momento removes it from active gallery storage and related face descriptors. Deleted media cannot be restored through Momento. Limited residual copies may persist briefly in encrypted backups, security logs, or processor systems until those systems rotate — see our Privacy Policy.
  • You are solely responsible for downloading and preserving your photos. Momento is not a backup service. We strongly recommend downloading important photos promptly after your event and not relying on the platform as your only copy.
  • Momento is not liable for loss, corruption, or unavailability of photos for any reason, including (but not limited to) storage failures, retention expiry, account suspension, or early deletion in accordance with these terms. Our total liability in connection with any photo loss is limited as set out in the Limitation of Liability section below.

Optional AI and biometric features

Recap curation, awards, photo-challenge verification, optional upload moderation, and Find me use automated and AI-assisted processing. You use these features at your own discretion and risk. Momento does not warrant that AI outputs or face matches are accurate, complete, unbiased, or suitable for any particular purpose. Hosts remain responsible for reviewing outputs before public sharing and for any harm arising from reliance on them, except where liability cannot be excluded by applicable law.

AI recap & awards

Optional recap curation, awards, photo-challenge verification, upload moderation, and Find me matching may send image previews or image data to Google Gemini for the relevant feature. Recap videos and auto-generated awards are provided for entertainment. They may not perfectly represent every guest or moment. Momento does not guarantee accuracy, quality, or availability of AI outputs. Hosts are responsible for reviewing content before sharing publicly. Recaps are generated when the host triggers them — not automatically on a fixed schedule.

AI recap generation limits. When enabled for an event, automatic AI recap curation is limited to one generation on the free plan and three on paid plans. Choosing your own photo set for a recap does not use an automatic generation credit. Limits are disclosed in the recap screen and event dashboard.

Acceptable use and prohibited content

Do not upload, request, create, share, or use the Service to distribute:

  • child sexual-abuse material, sexual exploitation, grooming material, or any sexual content involving a minor;
  • non-consensual intimate imagery, sexual content uploaded without the necessary consent, or content that exploits or endangers a person;
  • credible threats, violent or extremist content, hate, discrimination, harassment, bullying, doxxing, or content intended to harm another person;
  • unlawful, infringing, deceptive, defamatory, privacy-invasive, or otherwise harmful content.

You are responsible for content you upload and for ensuring it complies with law and these Terms. We may remove or disable content, suspend an account or event, preserve information, and report matters to authorities where required or appropriate. These rights do not limit responsibilities that Momento cannot lawfully exclude.

Processors and AI services

You authorise Momento to disclose the minimum content and personal data needed to the service providers listed in our DPA solely to provide the requested or enabled feature. This can include Google Gemini for Find me, recap curation, awards, photo-challenge verification, and optional moderation. Those providers process data under their own applicable terms and privacy policies.

Momento does not sell personal data or share it with advertising or marketing agencies for their own use. Our liability limits and your responsibilities apply only to the extent permitted by law.

Payments

  • Paid plans are one-time payments per event, processed via Razorpay.
  • Add-on entitlements (photographer import, guest shots, video clips, Find me, and similar) apply per event as described at checkout and in Plan & limits. Usage caps, including photographer import limits and AI recap generation limits, are enforced in the product.
  • Payments are generally non-refundable once the event has been used (photos uploaded or guests joined).
  • If you paid but could not use core paid features due to a verified platform fault before meaningful use, contact admin@momento.camera within 7 days — we will review refund requests in good faith.
  • Prices are listed in INR and may change without notice for new events. Mandatory consumer rights under Indian law still apply where they cannot be waived.

Prohibited use

  • Do not use the Service to distribute illegal, harmful, or infringing content.
  • Do not attempt to bypass rate limits, upload limits, or security measures.
  • Do not use automated tools to scrape, download, or extract data from the Service.
  • Do not impersonate other users or misrepresent your identity.

Termination

We may suspend or terminate your access if you violate these terms. You may delete your account from the dashboard (web) or Settings (mobile). Deleting an account permanently removes hosted events and associated photos.

Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Momento, its operators, affiliates, and service providers from and against any claims, demands, losses, liabilities, damages, penalties, and expenses (including reasonable legal fees and investigation costs) arising out of or related to: (a) your content or events; (b) your uploads, imports, or moderation decisions; (c) your enabling or use of Find me or other optional AI features; (d) your failure to provide required notice or obtain required permission or consent from people shown in photos, including biometric or facial-data claims by guests or non-users; (e) your violation of these Terms or applicable law; or (f) your violation of any third-party rights.

If you are a host, this indemnity includes claims brought by your guests, attendees, clients, or people depicted in event media. Momento may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate. This section does not require you to indemnify Momento for Momento's own fraud, wilful misconduct, or liability that cannot be allocated by contract under mandatory law.

Limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

WITHOUT LIMITING THE FOREGOING, MOMENTO IS NOT LIABLE FOR: (i) PHOTO OR VIDEO LOSS, CORRUPTION, OR UNAVAILABILITY; (ii) FIND ME OR OTHER AI OUTPUT ERRORS, OMISSIONS, OR MISMATCHES; (iii) ACTS OR OMISSIONS OF HOSTS, GUESTS, UPLOADERS, OR THIRD-PARTY PROCESSORS BEYOND MOMENTO'S REASONABLE CONTROL; OR (iv) CLAIMS ARISING FROM A HOST'S OR UPLOADER'S FAILURE TO OBTAIN LAWFUL BASIS, NOTICE, OR CONSENT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR A SPECIFIC EVENT IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THAT EVENT IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000 IF YOU USED A FREE PLAN.

Some jurisdictions do not allow certain limitations — in those cases, our liability is limited to the minimum permitted by law. Nothing in these terms limits liability that cannot be limited under mandatory consumer protection, data-protection, or biometric-privacy laws.

Time limit to bring claims

To the extent permitted by applicable law, any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after the claim accrues or becomes known (or should reasonably have become known) to you, unless a longer period is required by mandatory law. After that period, the claim is permanently barred.

Dispute resolution

These terms are governed by the laws of India. Courts in Bangalore, Karnataka have primary jurisdiction for disputes that are not subject to mandatory consumer forum or other non-waivable jurisdiction rules. If you are a consumer in the EEA, UK, or another jurisdiction with mandatory local consumer rights, you may also have the right to bring claims in your country of residence where required by law.

Informal resolution first. Before filing suit, arbitration, or a regulator complaint against Momento (other than a complaint required by law), contact admin@momento.camera with a written description of the dispute and requested relief. We will attempt good-faith resolution within 30 days.

Business users. If you use the Service primarily for commercial event services and the dispute exceeds INR 50,000, either party may elect binding arbitration in Bangalore under the Arbitration and Conciliation Act, 1996, before a single arbitrator, except for claims seeking injunctive relief for misuse of the Service, intellectual property, or unpaid fees. Either party may still seek interim relief from a competent court.

To the extent permitted by applicable law, you and Momento agree to resolve disputes individually and not as a class, collective, representative, or private attorney general action. If a court finds any part of this paragraph unenforceable as to a particular claim, that claim proceeds on an individual basis only.

General

  • Entire agreement: These Terms, the Privacy Policy, and documents incorporated by reference constitute the entire agreement regarding the Service.
  • Severability: If any provision is held invalid, the remainder stays in effect.
  • No waiver: Failure to enforce a provision is not a waiver of future enforcement.
  • Assignment: You may not assign these Terms without our consent. Momento may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure: Momento is not liable for delay or failure caused by events beyond reasonable control (including outages, acts of God, war, labour disputes, or third-party service failures).

Mobile apps and App Store terms

Apple: If you access the Service via an application downloaded from the Apple App Store, you acknowledge that these terms are between you and Momento, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to furnish maintenance or support for the app. In the event of any failure to conform to any applicable warranty, you may notify Apple to request a refund of the app purchase price. Apple is not responsible for addressing any claims by you or a third party relating to the app. You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

Google: If you access the Service via an application downloaded from the Google Play Store, you acknowledge that these terms are between you and Momento, not Google. Your use of the Android app must comply with Google Play's current policies. You acknowledge and agree that Google is a third-party beneficiary of these Terms and has the right to enforce them against you.

Notice for California residents

Under California Civil Code Section 1789.3, California users of the Service are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
